4. Account Responsibility
Clients are responsible for maintaining the confidentiality of account credentials and for all activities performed under their accounts. HostEnex will not be liable for unauthorized access caused by weak passwords or negligence.
5. Payment & Billing
- All services must be paid in advance unless otherwise specified.
- Invoices are generated before the due date.
- Failure to pay may result in suspension or termination of services.
- Prices are subject to change with reasonable notice.
- Taxes and applicable government fees may be added where required.
6. Renewals
Hosting plans, domains, and other recurring services may be renewed automatically unless canceled prior to the renewal date. Customers are responsible for ensuring valid payment information is maintained.
7. Refund Policy
HostEnex offers a limited money-back guarantee on eligible hosting plans as advertised on our website. The following services are generally non-refundable:
- Domain registrations, renewals, and transfers
- SSL certificates
- Dedicated servers
- VPS services
- Software licenses
- Setup fees and administrative charges
- Third-party add-on services
Refund requests must be submitted through the client area or support department for review.
8. Acceptable Use Policy
Clients agree not to use HostEnex services for:
- Illegal activities
- Fraudulent transactions
- Phishing or scam websites
- Malware distribution
- Spam or unsolicited bulk email
- Copyright infringement
- Adult content prohibited by applicable laws
- Activities that threaten network stability
HostEnex reserves the right to suspend or terminate services involved in abusive or prohibited activities without prior notice.
9. Resource Usage
Shared hosting accounts must use server resources responsibly. Excessive CPU, memory, bandwidth, disk I/O, or database usage that negatively impacts other customers may result in temporary limitations, suspension, or upgrade recommendations.
10. Data Backup
While HostEnex may provide backup systems as a courtesy, customers remain solely responsible for maintaining their own backups. HostEnex does not guarantee the availability or recovery of backup data.
11. Domain Registration
Domain registrations are governed by applicable registry and registrar policies. Customers are responsible for maintaining accurate WHOIS information and ensuring timely renewals.
12. Service Suspension & Termination
HostEnex may suspend or terminate services for:
- Violation of these Terms
- Non-payment of invoices
- Abusive behavior toward staff
- Security threats or network abuse
- Legal or regulatory requirements
Termination does not relieve the customer of outstanding financial obligations.
13. Uptime & Service Availability
HostEnex strives to maintain high service availability. However, uninterrupted operation cannot be guaranteed due to maintenance, hardware failures, force majeure events, or circumstances beyond our reasonable control.
14. Limitation of Liability
HostEnex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, business opportunities, or data arising from the use or inability to use our services.
15. Indemnification
Customers agree to indemnify and hold harmless HostEnex, its employees, affiliates, partners, and service providers from any claims, damages, liabilities, and expenses resulting from misuse of services or violations of these Terms.
16. Intellectual Property
All HostEnex trademarks, logos, branding materials, website content, software, and documentation remain the exclusive property of HostEnex unless otherwise stated.
17. Privacy
Customer information is handled according to our Privacy Policy. By using our services, you consent to the collection and processing of information as described therein.
18. Force Majeure
HostEnex shall not be held responsible for delays or failures caused by natural disasters, wars, government actions, internet outages, labor disputes, pandemics, or other events beyond reasonable control.
19. Amendments
HostEnex reserves the right to update these Terms & Conditions at any time. Continued use of services after modifications constitutes acceptance of the revised Terms.
20. Governing Law
These Terms & Conditions shall be governed and interpreted in accordance with the laws applicable in the jurisdiction where HostEnex operates, without regard to conflict of law principles.
